Building Work Levy – Class 2 Buildings

The NSW Government has announced that the new building work levy will commence for class 2 buildings on 4 July 2022.

The building work levy will apply to building work on class 2 buildings, and buildings that have a class 2 part, where an expected completion notice (ECN) is submitted or amended after 3 July 2022.

The levy will apply to building work on buildings with five residential premises or more for:

  • new buildings
  • addition of storeys to existing buildings
  • remediation, renovations or alterations to existing buildings with building work valued at more than $150,000 (incl GST).

NOTE: building work that is exempt under the Design and Building Practitioners Act 2020, will not have to pay the levy.

Developers will need to pay the levy through the NSW Planning Portal, as part of their submission of an expected completion notice. This must happen before they apply for an occupation certificate. Certifiers will only issue occupation certificates after the levy has been paid in full, unless a written exemption has been granted by NSW Fair Trading.
